Terms and Conditions

This agreement sets out the Terms and Conditions (“Terms”) applicable to customers of KimaroTec, a developer company specializing in website development and annual support and maintenance services. By ordering our products or services, you bind yourself to this agreement and certify that you agree to these Terms in full. These Terms are subject to change without prior notice.

1. Services and Products

KimaroTec provides website development services and annual support and maintenance for clients. All products and services are provided on an “as is” and “as available” basis. Our software and services are downloadable, fully functional, and available for evaluation through a “try the demo-before-you-buy” option. Please use the demo to ensure our products meet your needs before purchasing.

2. Payment Terms

  • Website Development: Payment for website development is a one-time fee, due in full at the time of purchase. The total amount (100%) must be paid, and all sales are final (see Cancellation and Refund Policy below).
  • Support and Maintenance: Annual support and maintenance services are billed yearly at €90/year via an automatic PayPal subscription. This subscription covers updates, bug fixes, and basic support as outlined at the time of purchase.

3. Cancellation and Refund Policy

  • Website Development: Once purchased, website development services cannot be canceled, and no refunds will be issued under any circumstances. All sales are final, and 100% of the agreed amount must be paid.
  • Support and Maintenance: The annual support and maintenance subscription is managed through PayPal. To cancel your subscription, you must notify us and cancel the subscription via PayPal at least one (1) month before the renewal date. Failure to cancel within this period will result in automatic renewal and payment for the next year, with no refunds provided.
  • Refund decisions, if any, are at the sole discretion of the KimaroTec agent handling your request. No refunds are guaranteed or promised unless explicitly stated otherwise.

4. Warranty Disclaimer

KimaroTec disclaims any implied warranties. Our software and services are provided “as is,” and you assume all risks associated with their installation, configuration, and use. There are no warranties, claims, or representations made by KimaroTec—express, implied, or statutory—including warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. KimaroTec does not guarantee that our products or services will always be available, accessible, accurate, complete, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not apply to you.

5. Limitation of Liability

KimaroTec, its employees, management, or affiliates shall not be held responsible or liable for any damages—direct, indirect, punitive, or incidental—resulting from the use or misuse of our products or services, including any failure, suspension, or termination of services. These exclusions are an essential part of this agreement and influence the pricing of our offerings.

6. Support Services

KimaroTec provides free support for bug fixes with every software or website purchase, as outlined in the offer at the time of purchase. Additional support, enhancements, or customizations will incur extra costs, to be agreed upon separately.

7. Pre-Sales Questions

Q: Is it a one-time payment?
A: No, website development requires a one-time payment, but support and maintenance require a yearly payment of €90/year for updates and support services.

8. Governing Law
